The Impact of Uterus Transplantation on the Establishment of Lineage and Inheritance in Islamic Jurisprudence A Comparative Jurisprudential Study

Abstract

Uterus transplantation is one of the most prominent modern medical developments in infertility treatment. It enables some women who lack a uterus congenitally, or who have had it removed for medical reasons, to become pregnant and give birth. Although this technique is still relatively recent, it has raised deep jurisprudential questions concerning motherhood, lineage, and inheritance in Islam, requiring a careful legal study that combines medical facts with Islamic legal controls.
Islamic jurisprudence has paid great attention to determining lineage because of its direct effects on inheritance. Inheritance is among the greatest rulings of Islamic law because it involves rights and divine limits. Hence the importance of this research, which examines the impact of uterus transplantation on Islamic inheritance from two angles:
Uterus transplantation without ovaries.
Uterus transplantation with ovaries.
The central issue lies in determining the legal mother in each case, since establishing lineage determines who is entitled to inheritance. Is the mother the owner of the transplanted uterus, the owner of the egg, or does the matter require detailed analysis according to the medical condition and nature of the transplant?
